END USER LICENCE AGREEMENT

• End User Licence Agreement

  • a) Throughout this licence Predatron shall be referred to as the “Author“.
    b) The definition ‘purchased item/product’ shall refer to any item purchased at
    https://www.predatron.com.
    c) The definition “Buyer” shall mean anyone who has purchased and downloaded
    this licence and associated product.
  • By purchasing a product the Buyer accepts responsibility to have read and understood the contents
    of this licence, and shall agree to all terms set out in this licence
  • Steve Pinchbeck a.k.a. Predatron is recognised as the sole Author of the content of any purchased item at https://www.predatron.com, and retains all copyright to the enclosed materials.
  • The Buyer is purchasing a licence to use the product. It is a is a non-exclusive, non-transferable licence. Ownership and copyright of the product remains with Predatron. This licence grants the Buyer to use the product for both personal and commercial use with specific restrictions:-
    • The Buyer can use any product for game development either as a hobby or as a professional. However you must give the appropriate accreditation either using the artist name of Predatron or Steve Pinchbeck and a link back to the website at www.predatron.com. Otherwise no authorisition can be granted for the use of any of Predatron products in any game development, whether this is a standalone or MMO game. Please take note of following stipulations as these also pertain to game usage.
    • The Buyer cannot make any alterations, amendments or develop the 3d mesh further without permission from the Author. In certain circumstances it may be possible to grant permission based on particulars of the intended use. It is advised that the Buyer contact the Author for clarification and advice of any additional licensing costs, if any, in this particular circumstance.
    • The Buyer cannot alter, develop or copy the original 3D geometry to create a derivative 3d model for commercial use in any form without permission from the Author. In certain circumstances it may be possible to grant permission based on particulars of the intended use. It is advised that the Buyer contact the Author for clarification and advice of any additional licensing costs, if any, in this particular circumstance.
    • The Buyer cannot make any 3D print(s) from any Predatron product for any commercial purpose without permission from the Author. In certain circumstances it may be possible to grant permission based on particulars of the intended use. It is advised that the Buyer contact the Author for clarification and advice of any additional licensing costs, if any, in this particular circumstance.. The Buyer can however make a 3D print of any Predatron product solely for personal use only.
    • The Buyer can create artwork from the renders of this product, such as posters, advertising materials, illustration, printable projects such as creating invitations, stationery, paper craft designs, web page/blog graphics and similar for sale
    • The Buyer can create animations with the product, for sale. These would include formats such as .gifs, .mov, .avi, .mp4, .mpeg.
    • If there are any other commercial uses not covered herein that you are interested in using the product, please contact store@predatron.com
  • The Buyer may not under any circumstances redistribute or sell the purchased archive file,
    this means any or all of its contents this includes through online communities such as Second Life.
  • The Buyer cannot store any purchased item at any place on a network or on the Internet where it may be referenced by a third party, this includes but is not limited to, yahoo lists, emailing, ftp, my space, warez, etc.. Sharing these products, in part or as a whole, is strictly prohibited and is against the law.
  • If the Author can show that any of the original material can be extracted from the Buyer’s derivative work, the Author can demand both the original and derivative work, and all copies thereof
    to be deleted, and any such action that is found to be in breach of Copyright or contravenes contents
    contained within this licence, the Author shall reserve the right to take steps to formulate legal
    proceedings against the Buyer. For example, the Buyer cannot make an image of a texture map mapped
    to a flat plane, so that the original texture map can then be cut & pasted from the resulting rendered
    or captured image. This is designed to protect the Author from the Buyer releasing work which lets
    other third parties obtain the copyrighted material, however these restrictions are not meant to infringe
    upon the artistic endeavours of the Buyer.
  • The Buyer cannot under any circumstances use this product for illegal, hateful, harmful purposes including pornography, crimes against children and animals, racist or religious material or anything that would cause harm or offence. The Author will accept no liability from any resulting legal proceedings or claims for damages should this product be used in any manner stated previously.
  • The Predatron website offers a limited 90 day refund policy. If you have bought a product in error or are not total satisfied then a refund can be issued. In the unfortunate event that there is a problem with the purchased product, the Author will work with the Buyer to fully rectify the problem. On the receipt of any refund any associated product that has been downloaded must be deleted from the Buyer’s computer forewith and no copies are to held on any other storage device, such as memory sticks, cloud technology, websites, hard disks, CD’s, DVD’s or their like.
  • All items purchased at https://www.predatron.com are thoroughly tested and once passed the testing
    phase it is deemed fit for use. The Buyer accepts responsibility for checking any systems requirements
    that are posted with each purchased item, these can be found on the product page via the website and in
    the ReadMe file (which can be viewed via the website before purchase).
  • FREE Products are downloaded from https://www.predatron.com as is. They can be used for commercial or non-commercial projects. The same terms and conditions outlined in this EULA still apply to FREE products.
  • The Author reserves the right to alter or amend the terms set out in this licence at any time. The Author shall endeavour to make all attempts to make known that this licence has been updated or amended by
    posting the very latest version at https://www.predatron.com and the relevant product page. If a purchased product has had its licence amended then all
    previously supplied licences shall become null and void, at that stage a new licence can be downloaded
    via the website at https://www.predatron.com
